in again tomorrow. we will talk about that coming up. >> good morning everybody, it is thursday. >> is a very busy morning and we want to start off with breaking news out of the south bay with reports of a three alarm fire at a four unit apartment complex on underwood drive. >> firefighters got the call around to 45 this morning. no word if anyone was inside. we have a crew on the way and we will bring a live report as soon as possible >> problems on the roads, trees are down, the weather is bad and elisabeth is all over this >> oakland, the scene of a fatal accident, we're getting reports of a lot of trees down this morning. southbound highway 13 at park boulevard, a multi vehicle crash with a tree down in the roadway. at one point a person was trapped underneath the tree so they're working hard to clear the scene.

a coroner has been called out so we will be a fatal it accident investigation. people are using on and off ramps to get by. we are sending a live report to the seat. in the meantime, let's go to highway 17 at the summit, both directions are shut down because a tree is completely blocking the roadway. emergency crews are out there working to clear that tree to the right shoulder. in the meantime, both lanes of highway 17 are completely closed down. the bay bridge, high wind advisories in effect this morning so we have another morning to you where you need to be extra careful on the roadways. so far, things look ok across the san mateo bridge out of hayward. >> the rain is not going away anytime soon >> let's go over to lawrence and find out what will and >> in the santa cruz announced,

almost 11 in. of rain in the last couple of days which is why they are in trouble. we continue to see some rain fall around the bay area although it has tapered off a little bit. a lot of drizzle beneath the doppler radar so even though it does not show up allot we see plenty of drizzle to keep the road with slippery. more rain moving into the bay area, this will be sliding to the south to route the day so we will see rain on and off through the better part of the day. this next system is not being picked up well but it is moving on by and it will bring more rain today and a bigger storm on friday. outside now we have drizzle and temperatures running mainly into the fifties. fairly mild to begin today but in the afternoon we're looking at numbers in the '50s and '60s with plenty more rain to come. >> the san lorenzo river is out

of its banks and threatening war damage at the boardwalk because of all the rain in the mountains. the river has swollen from more than 9 in. of rain. it is rushing along the edge of the boardwalk. crews have piled up rocks and sand to try to keep the water out. it is reported the flooding is already doing thousands of dollars of damage >> quite a bit of damage around the bay area in the last 24 hours. high winds brought down several trees. pg&e said all the power has since been restored but it was quite a mess. three trees toppled onto a home in sonoma county yesterday. this is near piedmont rio near the russian river. over in oakland, a candy store remains closed after water came pouring through the ceiling. the owner hopes to reopen by

radar, all you need to do is go to cbs sent to cisco dot com and click on whether >> the governor jerry brown has announced a new proposal for tax increases with some of the money likely to go for education. the revised plan calls for raising the state sales tax by a quarter cent per dollar. the 1 percent tax site for people making over to undertake the thousand dollars per year and a 3 percent hike for those who make over a half-million dollars. the idea is to unite behind just one initiative for taxing on the november ballot. the governor had been trying to convince the other groups to drop their initiatives. >> my concern is to build greater support for the tax revenue we need but my goal is

>> we are following breaking traffic news right now out of oakland. all the lanes of highway 13 by park boulevard are completely shut down. the accident just happened in the last half-hour or so. all lanes are blocked and they need to do a fatal accident investigation. there is a large tree down in the roadway so chp is giving us the new estimated time of reopening in another two hours. this will take a while to clear and you will want to use alternate's like 580. we have a live report headed to

the scene. >> protesters in afghanistan want a u.s. soldier to be prosecuted in their country for the shooting death of 16 civilians. yesterday military officials transferred the suspect to kuwait. the official told cnn that this is because kuwait as a u.s. military legal infrastructure to handle the situation. president obama it emphasizes the incident will not change the u.s. plan to hand over security. >> a homeowner has lost his fight to save his home from foreclosure. he called cbs five saying he is not leaving his property and even blocked the access to this parking garage but sheriff's deputies came by yesterday has scheduled to seize the property. >> they have taken everything

and i'm trying to bring awareness it just could not work out a solution. we are following some breaking news down near santa cruz. there is a downed tree blocking several lanes on highway 17. matt is on the scene right now >> is a pretty large tree appears to be blocking both lanes of southbound highway 17 just before the summit. alternate traffic is stopped to a standstill and cars are slowly getting by on the north side because firefighters are on both side and there is a plant open on the northbound side. for fire trucks are on the sea and and they have chainsaws so

blitz is called, tips for former smokers. it is designed to educate americans about the dangers of smoking through the stories of former smokers and now suffer from a variety of illnesses. the campaign begins on friday. >> more medical pawnshops are set to open in oakland despite a recent federal crackdown. the city just approved for new permits, doubling the number of operations. federal raids last fall and worried landlords may have discouraged potential operators. only one of the new shops as an approved location and the other three have four months to find a spot that it appears to city royals. >> it has been rainy and it will continue to rain. >> right now, a heavy drizzle around a good part of the bay area. high-definition radar is up and you can see light showers barely being picked up but there is

plenty of moisture moving in off the pacific. still, the most amount of rain being found in the north bay. we will watch this picked up and continue on and off throughout the day today. probably not as heavy as yesterday. temperatures in the '50s right now. of the afternoon, a fairly mild day. cloudy and wet on and off throughout the day. here is the system moving on shore quite rapidly and it will keep things going throughout the day and a more impressive one is lining up in the pacific as the jet stream remains locked in place. that will allow the storms to sweep on shore and bring heavy rain at times, especially friday into saturday. showers and on and off throughout the day. it looks like more weather is

coming up our direction. we need the rain but we're starting to see trouble with local rivers and creeks. it winter storm watch in the high country, 2-3 ft. of snow coming in the high country. the next few days we will see more rain on the way. probably some heavy rainfall overnight friday into saturday. >> unfortunately, we have a couple of problems we're dealing with right now. let's go to our first one in oakland. in the meantime we can show you a map of the exact location. in oakland, a fatal malty vehicle crash. southbound lanes of highway 13 are shut down and they are diverting cars onto the on and off ramps. there is a large tree in the roadway and they're telling us

that it will take a couple of hours to clear the accident. elsewhere, let's go down towards the santa cruz mountains. you may have just heard that live report, the southbound lanes of highway 17 are completely blocked right now due to a fairly large tree that fell in the roadway. one northbound lane is also shut down and traffic is getting by at a slow crawl. a live look at the san mateo bridge, still slippery and windy across many bridges. we have a couple of wind advisories, one for the bay bridge, one for the richmond san rafael bridge. coming up, we will get a live report from mobile 5. we will have more traffic in just a few minutes. >> hbo has pulled the plug on

injury he says was caused by an iphone. travis dickson says he was playing a game on the device on monday when it suddenly started to get hot and then blew up in his hand. he claims that he has bruised his hand and lost movement of his fingers. apple says it is working with him to figure out what happened. still no word on what apple thinks about the latest tribute to steve jobs >> it is called theiceo. it is outfitted with the iconic uniform of a mock turtleneck and wire rim glasses. only 1200 are being made and apple might try to stop production as it did with an action figure earlier this year. >> it started with kids and another group will be able to speed through airport security

>> crews are keeping a close eye on the santa cruz boardwalk this morning. a nearby river is threatening the amusement park. heavy rain yet to come and we will talk about that coming up. >> we are following a fatal accident and oakland and we will have the details coming up. >> a very busy morning because of all the wet weather. we begin with developing news in west san jose >> that is where fire crews knockdown a large apartment fire off of under would drive. paramedics had to treat one firefighter >> we just arrived where the residents were displaced >> good morning, 17 people

displaced by this fire. these people including eight children, and lived in four apartments and the building was set on fire, it looks like it started on the lower floor where there is one apartment and quickly spread to the second floor where there are three apartments. you mentioned a firefighter was injured, actually he felt through the roof of the building into the attic and the attic was fully engulfed in flames. luckily he had his gear on which protected him. he did sustain a significant injury to his hand and he is now in a hospital. obviously, the hand is a very important tool for a firefighter so they're trying to make sure they will be able to recover his ability to move the hand. that was the only significant injury in this fire. one other person was also

injured which is why there are some many firefighters on scene it looks like the fire started by a candle, an accidental fire started by a candle in the living room of the first floor. we are live on the scene and we will have more for you coming up at 6:00 >> how many people had been displaced? >> 17 people including eight children. the red cross is on the way to help them try to find somewhere else to live because of significant damage to the building. >> we want to go on to oakland where a deadly accident involving a tree has close part of highway 13 this morning.

>> we just spoke with a chp officer is on the scene and they are confirming one person is dead as a result of this accident and three people have sustained minor injuries. crews are on the scene trying to clear up what happened here it but we do know there was a two vehicle accidents involving a 20 ft. tree. they are not short of the chain of events and they don't know if the tree was already on the freeway when the first car hit that tree. they're trying to figure that out. what they do know is a small car hit the tree right by park boulevard on southbound 13 and three passengers in that car proceeded to get out of the car to move to the right side of the freeway and then a pickup truck also hit a tree, making it dearborn, striking the driver of the smaller car and that driver is the one who is pronounced dead this morning. either way, they say that right

now, the big concern is crews trying to clear out the area to reopen the freeway. the chp says it will take probably a little bit less than an hour to clear up the roadway. they are still waiting for the coroner to arrive on the scene. >> is there concern about the other trees? >> we do not know very much about that tree or other trees in the area but we will check on that and get back to you. >> use of another tree, several lanes of highway 17 are blocked >> is just south of summit road. mack, do we know if any cars were hit by the tree? >> it turns out that tree actually came down on top of a

small sedan, basically crushing it. the airbag deployed, and i just talked to the driver who was ok. he was pretty bruised up and not very happy but compared to the oakland situation, this is a fortunate man. the lane is still blocked for a tow truck to tollway the car that has been severely damaged. northbound 17 is slow. >> let's go over to traffic to find out what is going on with the nasty weather. >> it seems that trees are the issue this morning. we just heard the report us talking about this one, the

southbound lanes of highway 13 shot down. we have learned they are close between park boulevard and walking miller wrote. as kate just told us, probably another hour or so. the accident was first reported about 430 this morning so they need to complete their fatal accident investigation and then they need cleared the tree from the roadway. that is what is taking so long and in the meantime, 580 would be a good alternate. people are using alternate in the meantime. elsewhere, here is a live look at the nimitz freeway. not too bad as you pass the coliseum. slippery conditions and is pretty windy, as well. we have a wind advisory in effect for the bay bridge and richmond san rafael bridge. so far everything is on time with bart. back to you.

>> raindrops falling over the last few days still continue outside right now. some moisture is making its way into the bay. the heaviest amounts are in the north bay. drizzle is falling beneath our radar so it is keeping the roadways very slippery so be careful. we see a couple of cells making their way into the bay area. it looks like that will continue and intensify as we head drop the day. another wave of moisture moving from the pacific and sliding through fast. it will bring more on and off rain falls throughout the day today. it has been very impressive over the last couple of days. almost 11 in. of rain in ben lomond. over 7 in. of rain in canfield. almost 3 in. of rain in oakland. only 707 in. in san jose, that is the rain shadow effect that

we have been talking about. by the time the clouds make it to san jose there's not much left. >> miles away you have 1 ft. of rain. all that and there is worry about the boardwalk this morning, the san lorenzo river is out of its banks because of more than 9 in. of rain in the mountains. the river is rushing along the edge of the boardwalk this morning. the big concern is water eroding the structure. crews have tried to keep the sand and water out. the sentinel reports flooding has already done thousands of dollars of damage to the park. >> this has been an unusually dry winter in the bay area, especially santa clara valley. less than 4 in. has fallen on san jose since the season began in july. how only a quarter of what is

normal. part of the reason is a phenomenon that some experts are calling a rain shadow. >> some of the images i have seen are some of the most dramatic showing this affect >> 1 clouds are coming off the pacific ocean there forced higher in the sky by the santa cruz mountains which causes them to drop a lot of rain so they are dry by the time they reached the valley. the santa clara valley water district says that reservoirs' are currently at decent levels. if next season is just as dry, there would be concerned about the overall water supply. if you would like to track the storm coat your web site to get to our live interactive high- definition doppler radar and click on whether >> today is the deadline for schools in california to warn employees who might be laid off by next fall. there is a new proposal for a tax increase aimed at restoring

" >> set new jobless claims are down again and we have wholesale prices up this morning >> let's get a look at what is happening on wall street. ashley morris in joins us from york. >> overseas stocks extended a rally this morning. the nikkei index gained more than a half percent while hong kong was higher by a fraction. stocks made their biggest gain of the year but wall street might stayed mostly flat yesterday. >> some more positive news on the jobs front out this morning. first-time weekly jobless claims fell to 351,000 last week

matching the four year low. applications dropped 14,000 beating analysts' estimates. the consistent decline has coincided with the best three months of hiring in two years. goldman sacks stock fell more than 3% yesterday after a new york times op-ed piece written by an outgoing co-worker called the company toxic and destructive. an investment banker says " it makes me ill about how people talk about ripping their clients off over the last 12 months i've seen five different managing directors refer to their own clients hasn't met its " bold menorahs responded by sank we will only be successful if our clients are successful. this truth lies at the heart of how we conduct ourselves. millions of college students will see the interest rate on their loans double.

you want to check it out. a lot of rain fall around the bay area he continues this morning although it is a little bit lighter than what we have seen. the roadways are very slippery and we have seen heavy drizzle falling beneath the radar so watch out for that. showers continue in oakland and san francisco. it will be picking up throughout the day today so here is more rain coming our way. it will be wet on and off for the better part of a day. temperatures will stay rather mild. let's plan on fifties and even mid-60s by the afternoon. the next band of moisture will keep things going pretty well through the better part of a day. another series of storms will roll into the bay area and maybe another one coming in late in the day. computer models picking up on the showers on and off through the better part of the day of area 0 it looks like it will continue right into the weekend as well.

the next couple of days it is likely to turn into some more substantial rainfall in the next couple of days. st. patrick's day, cold showers in the fifties but we should have plenty of rainbows all around the bay area. >> the roads are still slippery so even though the rain is not as bad, we have seen numerous problems including this fatal accident that we have confirmed in oakland. they are working to clear a tree from the roadway so you're looking live, southbound highway 13 by the park boulevard exit. they have shut down the southbound lanes of highway 13 between park and walking miller wrote. the exact cause of how the accident happened is still under investigation but the biggest issue is working to clear the

roadway of the fairly large tree that fell. they also have to complete their investigation because the coroner was called out so they are telling us 630-7:00 is when they hope to get wrapped up and get the southbound lanes of highway 13 opened. they are be touring cars off the top bracket. five day would be a much better alternate. let's check out some of the road conditions. greg is in mobile 5 this morning. he is driving across the bay bridge right now or may be heading off of it. there is a wind advisory in affect and it looks like that was the fremont street off ramp. there is a wind advisory across the bay bridge and the richmond san rafael bridge. coming up we will get a check of the traffic alert that we're following on highway 17. more details on that just

minutes away. >> it is a new and profitable proposal to get drunk drivers off california roadways. a state senator wants to offer $100 reward to anyone who reports an impaired driver. the money would be paid for by the drunk driver and it would only be awarded after a conviction anti-drug driving groups and the aclu have not weighed in yet >> schools will have the option to take pinks lime off the menu. the department of agriculture will announce it will give public schools a choice in ground beef purchases after so- called pink slime became a social media topic. it is ground beef partially treated with ammonia. the feds say they will give schools the option of buying meat that is not as lean without the treatment and they say that without the treatment it does meet federal safety standards.

the cia. disturbing incident happened last week as the flight was prepared to leave fort worth. a fellow crew members was kicked in the stomach and police report says that crewmember who was kicked does not want to press charges that she says the erratic behavior is the results of a mental health issue. the waves the gsa is trying to lighten not starting monday allow passengers 75 years and older to leave their shoes and like underwear on. similar rules have already gone to fight for young children estimate all goes well these rules could be relaxed elsewhere as well. that is a good thing. the tallest structure of the nation's capital appears to be sinking. that is according to a new observation by the national survey. surveyors say they noticed a 2 mm difference at several points around the monuments not much but enough.
